Шундан келиб чиққан ҳолда, «Қишлоқ хўжалиги кооперацияси тўғрисида»ги қонун ҳамда Вазирлар Маҳкамасининг «Агросаноат кластерлари мақоми ва уларнинг фаолиятини ташкил этиш тартиби тўғрисида»ги қарори лойиҳалари ишлаб чиқилди.
«Қишлоқ хўжалигида кооперация тўғрисида»ги қонуннинг қабул қилиниши қишлоқ хўжалигида кооперация муносабатларни шакллантиришнинг ҳуқуқий асосини яратиш, кооперативлар фаолиятини ривожлантириш, шунингдек, хўжалик субъектлари учун муносабатларни муфассал ҳуқуқий тартибга солишга ёрдам беради.
Қишлоқ хўжалигида кооперация муносабатларини ташкил топиши умумманфаатлар, муаммолар, мақсадлар ёки вазифалар тамойили бўйича жисмоний ёки юридик шахсларнинг бирлашиши алоҳида долзарблик касб этади.
Қишлоқ хўжалик кооперативи аграр секторда тадбиркорлик фаолияти, шу жумладан, ишлаб чиқарувчидан якуний истеъмолчигача бўлган тизимни такомиллаштириш учун дастак ҳисобланади.
Мазкур қонун лойиҳасининг қабул қилиниши орқали қишлоқ хўжалигида кооперация муносабатларини тартибга солувчи нормаларни ягона ҳужжатда унификация қилиш ва тизимлаштириш, ушбу соҳасидаги муносабатларни комплекс ҳуқуқий тартибга солиш, қонун ҳужжатларидаги зиддиятлар ва бўшлиқларни бартараф этишга эришилади.
Қонун лойиҳаси йирик кооперацияларни ташкил этиш, улар фаоиятини мувофиқлаштириш, давлат томонидан қўллаб-қувватлаш, молиялаштириш бўйича рағбатлантирувчи чора-тадбирларни қўллаш масалаларини кўзда тутади.
Шунингдек, «Агросаноат кластерлари мақоми ва уларнинг фаолиятини ташкил этиш тартиби тўғрисида»ги қарор лойиҳасида агросаноат кластерлари мақоми ва уларнинг фаолиятини ташкил этиш тартиби тўғрисидаги низомни тасдиқлаш назарда тутилмоқда. Унда:
- агросаноат кластерининг ҳуқуқий мақоми белгиланмоқда;
- агросаноат кластери фаолияти учун ер участкалари 30 йилдан 50 йилгача муддатга ижара ҳуқуқи асосида захира ерлар, бўш турган қишлоқ хўжалигига мўлжалланган ерлар, қайта тикланадиган ва фойдаланишга киритиладиган қишлоқ хўжалигига мўлжалланган ерлардан қонунчиликда белгиланган тартибда ажратилиши назарда тутилмоқда;
- қишлоқ хўжалиги товар ишлаб чиқарувчиларини агросаноат кластерларига мажбурий тартибда бириктириш амалиёти бекор қилинмоқда;
- қишлоқ хўжалиги товар ишлаб чиқарувчиларига республиканинг исталган ҳудудидаги агросаноат кластерлари билан шартнома тузиш ва уларга маҳсулот етказиб бериш ҳуқуқи берилмоқда;
- агросаноат кластерларини давлат томонидан қўллаб-қувватлаш шаклларини белгиланмоқда;
- агросаноат кластерлари фаолиятини мониторинг қилиш Қишлоқ хўжалиги вазирлиги зиммасига юкланган ҳолда, унинг механизмлари белгиланмоқда;
- агросаноат кластери мақомини бекор қилиш, ерга ижара ҳуқуқини бекор қилиш фақат суд қарори асосида амалга оширилиши назарда тутилмоқда.
Мазкур қарорнинг қабул қилиниши орқали агросаноат кластерларини ташкил этиш ва уларнинг фаолият юритишини таъминлашнинг ҳуқуқий асосларини яратишга, кластерларини ташкил этишда ваколатли давлат ва маҳаллий ҳокимият органларини ҳамда кластерларнинг ҳуқуқ ва мажбуриятларини аниқ белгиланишига ҳамда агросаноат кластерларини фаолиятини самарали йўлга қўйишда давлат ва маҳаллий ҳокимият органлари томонидан ер ажратиш, молиялаштириш масалаларида кўмаклашишни таъминлашнинг ҳуқуқий асосларини мустаҳкамлашга эришилади.
