Аллаяров Чори Қизириқ тумани қурилиш бўлимидан рухсатнома олиб, Сурхондарё вилоят қурилиш бошқармаси ва лойиҳа ҳужжатлари асосида умумий майдони 134 метр кв бўлган 2 қаватли Савдо ва ошхона биноларининг биринчи қаватини қуриб битказди. Лекин энди менинг ушбу дўконини бузиш учун фуқаролик ишлари бўйича Термиз туманлараро судига Худойназаров Исмоил Шерниёз ўғли даъво ариза киритди ва иш 2019 йил 18 октябрда кўриб чиқилиб даъвогарнинг даъвоси қаноатлантирилди.
Шуниси қизиқки, ФИБ Термиз туманлараро суди ҳам, ФИБ Сурхондарё вилоят суди ҳам Ўзбекистон Республикаси “Маъмурий тартиб-тамойиллар тўғрисида”ги қонуни бўйича ҳал этмади ва Аллаяров Чори тақдим этган далилий ашёларни инобатга олмади.
Шундан сўнг Аллаяров Чори Ўзбекистон Республикаси Қурилиш вазирлигига 11.07.2020 йилда шикоят қилди ва 2020 йил 16 июл куни Сурхондарё вилоят Қурилиш бошқармаси томонидан ўрганилиб Қурилиш вазирлигига юборилган жавоб хати нусхаси унга ҳам юборилди
Жавоб хатида шундай дейилган:
Ўрганиш жараёнида, Қизирик туман Давлат нотариал идорасининг 2017 йил 13 ноябрдаги 5961-сонли кадя шартномасига асосан фукаро Аллаёров Чорига тегишли булган туманнинг “Зарбдор” махалласи худудида жойлашган “Савдо дукони ва ошхона биноси”ни кайта ихтисослаштириш ва реконструкция килиш учун Қизирик туман Қурилиш булими томонидан 2019 йил 19 апрелдаги 12-сонли рухсатнома берилган хамда мазкур рухсатномага асосан фуқаро томонидан 2019 йил 28 майдаги 575/2019-сонли меъморий режалаштириш топшириғи олинган.
Мазкур бинони реконструкция қилиш буйича лойиҳа-таклифи ишлаб чикилган ва Архитектура-шаҳарсозлик Кенгашида 2019 йил 12 июлдаги 25-сонли баённома билан келишилган ва барча шаҳарсозлик хужжатлари ишлаб чикилиб, тегишли ташкилотлар билан келишилган хамда курилиш ишлари бошлаб юборилган.
Аммо фукаро И.Худойназаровга Қизирик туман хокимининг 2019 йил 13 майдаги Қ-2963-сонли карори билан “Савдо ва маиший хизмат курсатиш биноси” қуриш учун ажратиб берилган 0,02 га ер майдонини ажратиш жараёнида фуқаро Ч.Аллаёровга тегишли булган ер майдони инобатга олинмаган ҳолда ажратиб берилган ва шу билан бирга фуқаро И.Худойназаровга ажратилган ер майдонининг бир қисми фуқаро Ч.Аллаёровга тегишли ер майдони хисобланади.
Бундан ташкари ушбу масала юзасидан кўрилган суд ишларида фукаро И.Худойназаров фойдасига ҳал килув карорлари кабул килинган.
Юкоридагиларни инобатга олган ҳолда, фукаро Ч.Аллаёровга аппеляция тартибида юқори турувчи суд органларига мурожаат қилиши тўғрисида тушунтирилди.
Ушбу ҳужжатнинг электрон нусхасини Аллаяров Чори ҳам олди, аммо карантин туфайли Термиз шаҳрига бориб топшира олмади. Ушбу ҳужжатдан кўриниб турибдики, фукаро И.Худойназаровга Қизирик туман хокимининг 2019 йил 13 майдаги Қ-2963-сонли карори билан “Савдо ва маиший хизмат курсатиш биноси” қуриш учун ажратиб берилган 0,02 га ер майдонини ажратиш жараёнида фуқаро Ч.Аллаёровга тегишли булган ер майдони инобатга олинмаган ҳолда ажратиб берилган ва шу билан бирга фуқаро И.Худойназаровга ажратилган ер майдонининг бир қисми Аллаяров Чорига тегишлидир.
Фуқаролик ишлари бўйича Термиз туманлараро судининг 2019 йил 18 октябрдаги жавобгарлар Аллаяров Чори Намозович, Аллаяров Фахриддин Номозович ва Дониёров Ахмад Номозовичларга нисбатан ер майдонини жавобгарларадан мажбурий тартибда олиш ва ўзбошимчалик билан қурилган иморатларни ўз ҳисобидан буздириш ҳақидаги ҳал қилув қарорини ижро этиш учун Мажбурий ижро бюроси Қизириқ тумани бўлими шу йил 3 сентябр куни Ч.Аллаёровга хат юборди.
Шундай қилиб Ч.Аллаёров ўзига тегишли бўлган ер майдонида қураётган ва битай деб қолган иморатлари бузилиш арафасида турибди.
Қизиқ, низоли ер майдони Аллаёров Чорига тегишли эканлиги ва у амалдаги қонунларни бузмасдан янги дўконларини қураётганлиги маълум бўлди, лекин суднинг ҳал қилув қарори ўз кучида турибди ва шу қарорга кўра унинг битай деб қолган иморатлари бузилиб кетса, унинг ҳаражатларини ким тўлайди?
Албатта, ФИБ Термиз туманлараро суди тўламайди, чунки шу пайтгача суднинг адолатсиз қабул қилган қарори туфайли бузилган дўконлар учун суд етказилган зарарни тўламаган. Фақат тадбиркорга жабр бўлади, чунки “де-юре” бўйича (қонуний, расмий) тадбиркор ҳимоя қилинса ҳам, “де факто” бўйича (амалда, ҳақиқатда) бундай ҳолатда фақат тадбиркор зарар кўрган.
Ҳали тадбиркор Ч.Аллаяровга тегишли ер майдонида қурилаётган дўкон биноси бузилгани йўқ, охири нима билан тугаши номаълум. Низоли воқеа нима билан тугаганлигини албатта хабар берамиз.
