qonunda koʻrsatilganidek, ishni koʻrish bilan bogʻliq boʻlgan chiqimlar: guvohlar va ekspetlarga toʻlanishi lozim boʻlgan summalardan, ish uchun ahamiyatli boʻlgan joyni koʻzdan kechirish bilan bogʻliq boʻlgan xarajatlardan, alimentlar va zarur haqini undirish toʻgʻrisidagi ishlar boʻyicha javobgarni qidirish uchun qilingan hamda sudning hal qiluv qarorini ijro etish bilan bogʻliq xarajatlardan iborat boʻladi (FPKning 109-moddasi).
Guvohlar, ekspetlar, mutaxassislar va tarjimonlarga beriladigan pul, ular oʻz vazifalarini bajarib boʻlganlaridan soʻng, xarajatlar taraflardan undirib olinishidan qatʻiy nazar, sud tomonidan toʻlanadi (FPKning 112-moddasi).
Mehnat munosabatlarida boʻlgan xodimni sudda guvoh sifatida chakirilganida sudga kelishi munosabati bilan ishda boʻlmagan uchun vaqti uchun ish joyidagi urtacha ish haqi saqlanadi.
Xodimlarga mansub boʻlmagan guvohlar ishdan yoki odatdagi mashgʻulotlardan qoldirilganliklari haq olishga haqlidirlar. Bunday hollarda toʻlanadigan pulning miqdorini sud belgilaydi, lekin bu haqda mazkur joydagi tegishli malakali xodimning oʻrtacha ish haqidan ortiq boʻlmasligi kerak.
FPKning 113-moddasiga muvofiq guvohlar, ekspetlar, mutaxassislar va tarjimonlarga toʻlanadigan pulni yoki joyini borib koʻzdan kechirish xarajatlari uchun zarur boʻlgan pulni tegishli iltimos qilgan taraf oldindan toʻlab qoʻyadi. Agar mazkur iltimos ikki taraf tomonidan qilingan boʻlsa yoki guvohlarni, ekspetlarni, mutaxassislarni va tarjimonlarni chaqirish, joyiga borib koʻzdan kechirish sudning tashabbusi bilan bajarilsa, buning uchun kerakli summani taraflar baravar toʻlaydilar. Bu qonunlarda koʻrsatilgan summalar sud xarajatlarini toʻlashdan ozod qilingan tarafdan undirilmaydi.
Sud xarajatlarini toʻlashdan ozod qilish
Sud idoralarida koʻriladigan fuqarolik ishlari boʻyicha hamma hollarda ham sud xarajatlari undirilavermaydi.
Mustaqil Respublikamiz qonunlarining insonparvarlik ruhida tuzilganligi sud xarajatlariga oid huquqiy normalarda ham oʻz ifodasini topadi. qonunga binoan sud yoki sudya taraflarning mulkiy ahvollariga qarab, taraflarning biri yoki har ikkalasidan ham davlat daromadiga undiriladigan sud xarajatlarini toʻlashni kechiktirishga yoki boʻlib-boʻlib toʻlashga yoʻl qoʻyishi, shuningdek bu xarajatlarning miqdorini kamaytirishi yoxud bu xarajatlarni toʻlashdan butunlay ozod qilinishi mumkin.
Bu haqda FPKning 110-111-moddalariga va «Davlat boji toʻgʻrisida»gi yuqorida koʻrsatilgan qonunning 4-moddasida ayrim davlat budjetida turgan muassasalar, tashkilotlar ham davlat bojini toʻlashdan ozod qilinishi mumkinligi oʻz ifodasini topgan.
Ushbu darslikni uzlashtirishga yengillik tugʻdirish maqsadida boj toʻgʻrisidagi yuqoridagi qonunda imtiyoz berilganligini koʻrsatilgan.
Daʻvogarning talablari sud tomonidan qanoatlantirganida, u fuqarolik ishining yuritilishi tufayli qilgan xarajatlarning toʻlanishini talab qilishga haqli boʻladi. Bunday xarajatlar javobgarning daʻvogar oldidagi majburiyatlarni ixtiyoriy ravishda bajarmagani uchun va shu tufayli daʻvogar muayyan sud xarajatlarini qilishga majbur boʻlganligi uchun bu xarajatlar javobgar hisobidan undirilishi lozim boʻladi. Huddi shuningdek javobgar ham, agar daʻvogarning unga nisbatan qilgan daʻvo talablari rad qilinsa, ish yuzasidan qilgan xarajatlarning daʻvogar tomonidan oʻziga toʻlashini talab qila oladi.
