{"id":18509,"date":"2024-07-26T04:45:23","date_gmt":"2024-07-26T01:45:23","guid":{"rendered":"https:\/\/nor.uz\/?p=18509"},"modified":"2024-07-26T04:47:43","modified_gmt":"2024-07-26T01:47:43","slug":"xodimning-1-120-889-som-ustama-puli-sud-tomonidan-undirib-berildi","status":"publish","type":"post","link":"https:\/\/nor.uz\/?p=18509&lang=kr","title":{"rendered":"Xodimning 1.120.889 so\u2018m ustama puli sud tomonidan undirib berildi"},"content":{"rendered":"<p>Da\u2019vogar Adliya bo\u2018limi, Q.J ni manfaatini ko\u2018zlab sudga da\u2019vo ariza bilan murojaat qilib, javobgar maktabgacha va maktab ta\u2019limi bo\u2018limiga nisbatan ish haqiga qoshimcha to\u2019lanishi lozim bo\u2019lgan 1.120.889 so\u2018m ustama pullarini undirib berishni so\u2018ragan.<\/p>\n<p>Aniqlanishicha, mehnat shartnomasi va maktab direktorining buyrug\u2018iga asosan Q.J 2004 yil 01 avgust kunidan maktabning kimyo fani o\u2018qituvchisi vazifasiga ishga qabul qilingan va u hozirda ushbu lavozimda ishlab kelmoqda.<\/p>\n<p>Maktabgacha va maktab ta\u2019limi bo\u2018limining 2024 yil 12 yanvardagi 01\/7-sonli javob xatiga ko\u2018ra Q.Jga 2020-2021 yillar uchun jami 1.120.889 so\u2018m ustama so\u2018m ustama pullari hisoblangan.<\/p>\n<p>O\u2018zbekiston Respublikasi Prezidentining 2018 yil 19 fevral kunidagi \u201cAxborot texnologiyalari va kommunikatsiyalari sohasini yanada takomillashtirish chora-tadbirlari to\u2018g\u2018risida\u201dgi PF-5349-sonli Farmonining &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;7-bandi, \u201cg\u201d- kichik bandida davlat organlari va boshqa budjet tashkilotlarining zamonaviy axborot texnologiyalari va kommunikatsiyalarini joriy qilish va rivojlantirishga mas\u2019ul bo\u2018lgan xodimlariga beriladigan har oylik ustama miqdori davlat budjetidan, davlat budjetidan ajratilmagan bo\u2018lsa, ushbu tashkilotlarning budjetdan tashqari mablag\u2018lari hisobidan xodim lavozim maoshidan 100 foizdan kam bo\u2018lmagan miqdorda belgilanishi ko\u2018rsatilgan.<\/p>\n<p>O\u2018zbekiston Respublikasi konstitutsiyasining 42-moddasida, har kim munosib mehnat qilish, kasb va faoliyat turini erkin tanlash, xavfsizlik va gigiena talablariga javob beradigan qulay mehnat sharoitlarida ishlash, mehnati uchun hech qanday kamsitishlarsiz hamda mehnatga haq to\u2018lashning belgilangan eng kam miqdoridan kam bo\u2018lmagan tarzda adolatli haq olish, shuningdek ishsizlikdan qonunda belgilangan tartibda himoyalanish huquqiga ega.<\/p>\n<p>Mehnat kodeksining 243-moddasida mehnatga haq to\u2018lash ish beruvchi tomonidan xodimga uning mehnati uchun to\u2018lovlar belgilash va ularni amalga oshirish yuzasidan mehnat shartnomasi taraflari o\u2018rtasidagi mehnat to\u2018g\u2018risidagi qonunchilik, mehnat haqidagi boshqa huquqiy hujjatlar va mehnat shartnomasi bilan tartibga solingan munosabatlar tizimidir.<\/p>\n<p>Ish beruvchi tomonidan xodimning malakasiga, bajaradigan ishining murakkabligiga, miqdoriga, sifati va sharoitlariga qarab to\u2018lanadigan mehnat uchun mukofot summasi, shuningdek kompensatsiya xususiyatiga ega to\u2018lovlar (kompensatsiya xususiyatiga ega qo\u2018shimcha to\u2018lovlar va ustamalar, shu jumladan normal ish sharoitlaridan chetga chiqadigan sharoitlarda ishlaganlik, noqulay tabiiy-iqlim sharoitlarida ishlaganlik uchun shunday qo\u2018shimcha to\u2018lovlar va ustamalar hamda kompensatsiya xususiyatiga ega boshqa to\u2018lovlar) va rag\u2018batlantiruvchi to\u2018lovlar (rag\u2018batlantiruvchi xususiyatga ega qo\u2018shimcha to\u2018lovlar hamda ustamalar, mukofotlar va taqdirlovchi to\u2018lovlar) ish haqidir.<\/p>\n<p>Mehnat kodeksining 244-moddasi birinchi qismi ish beruvchining o\u2018z moliyaviy ahvolidan qat\u2019iy nazar, qonunchilikda mehnat haqidagi boshqa huquqiy hujjatlarda, mehnat shartnomasida belgilangan mehnatga haq to\u2018lash shartlariga muvofiq xodimlar tomonidan bajarilgan ish uchun haq to\u2018lashni amalga oshirish majburiyatini mustahkamlab quyilgan.<\/p>\n<p>Ish hujjatlariga ko\u2018ra, da\u2019vogar Q.J ga jami 1.120.889 so\u2018m ustama hisoblangan, ammo javobgar tomonidan to\u2018lab berilmaganligi sababli sud tomonidan maktabgacha va maktab ta\u2019limi bo\u2018limi hisobidan Q.J &nbsp;foydasiga ish haqiga qoshimcha to\u2019lanishi lozim bo\u2019lgan 1.120.889 so\u2018m ustama puli undirilishi belgilandi.<\/p>\n<p>Xulosa qilib aytganda ish beruvchi xodim bilan mehnat munosabatlariga kirishar ekan, ular mehnat munosabatlarini tartibda soluvchi qonun hujjatlari talablariga rioya etishlari kerak.<\/p>\n<p><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
