Ўша куни кафеда официант сифатида хизмат қилган Рохиля Ашурова эса ички ишлар идораси, прокуратура ходимларига бўлган воқеа ҳақида тушунтириш ёзганлигини айтиб, изоҳ беришдан бош тортди.
Ушбу ҳолат юзасидан вилоят ички ишлар бошқармаси қуйидаги маълумотларни тақдим этди.
“Маълум бўлишича, 2019 йилнинг 11 сентябрь куни соат 22:30лар чамасида Андижон шаҳри, Тинчлик кўчаси, 3-уй 18-хонадонда яшовчи фуқаро Ҳамракулов Жасурбек Андижон шаҳри, Нодира кўчаси, 1-уйда жойлашган “Камелот” кафеси олдида маст ҳолатда шовқин солиб, фуқароларнинг тинчлигини бузган. Шунингдек, фуқаро О.Болтабоева билан ҳеч бир сабабсиз жанжаллашиб, унга енгил тан жароҳати етказган. Ушбу ҳолатдан хабар топган шу ҳудудда тунги хизматни олиб бораётган Андижон шаҳри ИИОФМБ 6-сон ИИБ ХПГ ТП профилактика инспектори Абдуманнопов Сардор “Камелот” кафесига зудлик билан етиб келган ва Ж.Ҳамроқуловни тинчлантиришга ҳаракат қилиб, уни тартибга чақирган. Аммо фуқаро Ж.Ҳамроқулов профилактика инспекторининг қонуний талабларига бўйсунмасдан, унга фаол қаршилик кўрсатган.
Шундан сўнг, фуқаро Ж.Ҳамроқулов Андижон шаҳар ИИОФМБ 6-сонли ИИБ биносига олиб келиниб, белгиланган тартибда рўйхатдан ўтказилган. Ж.Ҳамроқулов билан профилактик тушунтириш ишлари олиб борилаётган вақтда, у маст ҳолатда ички ишлар ходимларига қаршилик кўрсатган ва ўзининг ҳаракатларини бошқара олмасдан мувозанатини йўқотиб, ерга йиқилиб тушган.
Мазкур ҳолат юзасидан ИИВ ЎХБ Андижон вилояти бўйича бўлими томонидан хизмат текшируви ўтказилган. 2019 йилнинг 8 октябрь куни хизмат текшируви хулосасига кўра, томонларнинг кўрсатувлари ўртасида қарама-қаршиликлар юзага келганлиги сабабли, ҳолатга ҳуқуқий баҳо бериш масаласи Андижон шаҳар прокуратурасига ҳавола этилган.
Мазкур ҳодиса юзасидан Андижон шаҳар прокуратураси томонидан терговга қадар текширув ҳаракатлари олиб борилиб, 2019 йил 12 октябрда фуқаро Ж.Ҳамроқуловга нисбатан Ўзбекистон Республикаси ЖКнинг 219-моддаси 1-қисми билан жиноят иши қўзғатилган.
Андижон шаҳри бўйича ИИОФМБ 6-сон ИИБ ХПГ ТП профилактика инспектори Абдуманнопов Сардор Собиржон ўғлининг ҳаракатларида жиноят аломатлари аниқланмаганлиги сабабли, ишни унга тегишли қисми ЖПКнинг 83-моддаси 2-бандига асосан ҳаракатдан тугатилган.
Ҳозирда фуқаро Ж.Хамроқуловга нисбатан ЖКнинг 219-моддаси 1-қисми ва 277-моддаси 2-қисми билан айб эълон қилинган. Жиноят иши ЖПКнинг 388-моддаси тартибида суд муҳокамасига юбориш чоралари кўрилмоқда”.
Шу ўринда мулоҳаза туғилади. Биринчидан, иккита олийгоҳни тамомлаган, банкларда раҳбарлик лавозимларида ишлаган Ж. Ҳамрақулов маст бўлиб фуқароларнинг тинчлигини бузиши, ички ишлар идораси ходимига қаршилик кўрсатиши қай даражада ҳақиқатга тўғри келади?!
Иккинчидан, хўп Ж. Ҳамрақулов маст бўлиб жамоатчилик тинчини бузибди, ички ишлар ходимига бўйсунмай, қаршилик қилибди. Ўша воқеа жойида бўлган ички ишлар ходимлари нима учун унинг қўлини боғлаб, олиб бориб қамаб қўймади. Бунга уларнинг кучи етмасмиди? Агар Жасурнинг гаплари тўғри бўлса, уни ана шу даражада уриш шартмиди?!
Тиббиёт ходимлари берган хулосада Ж. Ҳамрақуловнинг ҳақиқатдан тан жароҳати олганлиги қайд этилган. Ички ишлар маълумотномасида айтилганидек, Ж. Ҳамрақулов стулдан йиқилиб тушган бўлса, унинг бурни синиши, уст-боши қонга беланиши, ўзини йўқотиши, кўзлари кўкариши ҳақиқатга қанчалик тўғри келади?
Ушбу ҳолат юзасидан тергов-суриштирув ишлари олиб бораётган вилоят прокуратураси шубҳасиз, воқеага ҳуқуқий баҳо беради. Ким ҳақ, ким ноҳақ эканлигини айтиб, адолат юзага чиқишини таъминлайди.
Президентимиз ташаббуси билан мамлакатимизда қонун устуворлигини таъминлаш, фуқароларнинг ҳуқуқ ва эркинликларини ҳимоя қилишга қаратилган кенг кўламли ислоҳотлар амалга оширилмоқда. Бу борада олиб борилаётган ишлар беиз кетмайди. Муҳтарам Президентимизнинг “Инсон ҳамма нарсага чидаши мумкин, фақат адолатсизликка чидай олмайди” деган ибораси мутасадди идоралар вакилларига ушбу воқеа хусусида сўнгги фикр айтишда дастуриламал бўлади.
Ишонамизки, биз фикр юритган юқоридаги ҳолат юзасидан ҳам албатта, адолатли ҳукм чиқарилади.
