ЖК умумий қисми қоидаларига мувофиқ жазо тайинлаш деганда нималар тушунилиши керак?
Маълумки, жиноят қонуни махсус қисмининг моддаларини амалга татбиқ қилишининг барча қоидалари унинг умумий қисмида кўрсатилган. Махсус қисм нормаларини кўллашда умумий қисм нормалари йўналтирувчи ва тартибга солувчи нормалар бўлиб ҳисобланади. Демак, умумий қисмининг нормалари махсус қисмнинг калити ҳисобанади. ЖКда махсус қисм моддаларига тегишли бўлмаган бирорта модда йўқ. Масалан, ЖКнинг махсус қисмида жиноятлар учун жавобгарлик белгиланган бўлса, умумий қисмида жиноят тушунчаси (14-моддаси) берилган,махсус қисмида жиноятлар учун фақат жисмоний шахслар томонидан содир этилган жавобгарлик назарда тутилган бўлиб, умумий қисмининг 17-моддасида жисмоний шахс, 18-моддасида ақли расолик тушунчалари берилган. ЖК махсус қисмининг кўпчилик моддаларида жиноят бир гуруҳ шахслар томонидан қилинса, дейилган, иштирокчилик тушунчалари эса, 27-30-моддаларида берилган. Махсус қисм моддларида жиноят такроран, хавфли рецидивист, ўта хавфли рецидивист томонидан содир этилса, дейилади, уларнинг тушунчалари эса умумий қисмининг 32-34-моддаларида берилган.
ЖКмахсус қисми моддалари санкцияларида муайян доирада тайинландиган жазо турлари назарда тутилган, жазо тайинлаш қоидалари эса умумий қисмининг 57-63-моддаларида кўрсатилган ва хоказолар. Бундан ташқари, махсус қисми моддаларида назарда тутилмаган, аммо жазо тайинлашда эътиборга олиниши шарт бўлган бир қанча жиноят қонуни институтлари борки, бу институтларда шахснинг ижтимоий хавфли қилмиши жиноят деб топилиб, ЖК махсус қисмининг тегишли моддаси билан жавобгарликка тортиладиган бўлса, умумий қисмида назарда тутилган қоидаларнинг қўлланилишининг ўзи етарлидир. Масалан, жавобгарлик ва жазодан озод қилиш кўзда тутилган моддалар, тиббий йўсиндаги мажбурлов чораларини кўллаш, судланганлик ва уни ҳисоблаш қоидалари факат умумий қисмда кўрсатилган. Тўғри, ЖК махсус қисмининг моддаларида ҳам жавобгарлик ва жазодан озод қилиш (масалан, ЖКнинг 211-моддаси 4-қисми, 212-моддаси 4-қисми, 248-моддаси 4-қисми ва хоказолар) кўзда тутилган, аммо жавобгарлик ва жазодан озод қилишнинг бу турлари фақат ўша модданинг ўзи учун тегишли, ҳолос. Умумий қисмдаги жавобгарлик ва жазодан озод қилишни назарда тутувчи моддалари эса ЖКмахсус қисмининг бошқа моддаларига ҳам тегишлидир, Маълумки, суд жиноят учун жазо тайинлашда айбдорнинг қилмиши квалификация қилинган модданинг санкциясида кўрсатилган жазо турлари ва муддати доирасидан четга чиқа олмайди, аммо иш ҳолатларига кўра, айбдорнинг қилмиши квалификация қилинган модда санкцияси доирасида жазо тайинланса, жазо адолатсиз бўлиб қолади. Суд, ЖКнинг 57-моддасида кўзда тутилган енгилрок жазо тайинлаш қоидаларини қўллаб, енгилрок жазо тайинлаши ҳам мумкин.
